This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from http://www.outdoorplay.com (the “Site”).

Personal Information You Provide to Us:
We may collect the following personal information.

  • When you visit the Site, we may collect personal information you provide. For example, we collect information when you create an account, edit your profile, join our loyalty program, post reviews, make a purchase or return, attempt to make a purchase, file a claim, contact us via a customer service method, or subscribe to email or text messages. In addition, the types of information we collect about you include your name, email address, password, phone number, billing/shipping address, and financial information, such as debit and credit card numbers. We refer to this information as “Order Information.”
  • If you participate in surveys or contests, we may ask for your contact information, qualifying information, feedback, and background information, such as your age, gender, approximate household income, type of outdoor sport you enjoy, frequency in which you engage in your sport, and where you go to enjoy your sport.


When we talk about “Personal Information” in this Privacy Policy, we talk about both Order Information and Device Information.

Information We Collect Automatically:
We automatically collect information from you in various ways.

  • Transaction Information: When you make a purchase or return a product, we collect information, such as details about the product, pricing, the date of the transaction, and other information.
  • Device and Location Information: We collect online device information, including location information such as geo-location about your web browser, IP address, time zone, and some of the cookies installed on your device.
  • Information Collected by Cookies and Other Tracking Technologies: As you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

    • We use services provided by Google LLC including: Google Analytics, Google Adwords conversion tracking, and Google remarketing and Google Signals. These services use cookies and similar technologies to provide insights that help us improve our website based on usage behavior, measure the performance of our ads, and show you personalized ads on other websites that collaborate with Google. Google Signals compiles usage information across devices and Google services if you are signed into your Google account and have enabled this service for the purpose of ads personalization. Information collected by these services is aggregated and anonymized.     • We also partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Information We Collect from Third Parties:

We may also receive information about you from third-party sources.

  • We may obtain information from third-party sources about you. For example, we receive information about you from other sources to help improve the quality of our services and prevent or detect fraud.
  • Device and browsing information from third parties for marketing purposes, for example, to provide you with personalized ads on Outdoorplay and third-party websites and mobile services.
  • Demographic data, such as your age, gender, and sporting interests.
  • Social Media platforms in accordance with their procedures and policies.


How Do We Use Your Personal Information:

  • We generally collect the order information to fulfill any orders placed through the Site (including processing your payment information, arranging to ship, and providing you with invoices and/or order confirmations).
    • Additionally, we use this Order Information to communicate with you; screen our orders for potential risk or fraud; and, when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address) and, more generally, to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Outdoorplay is headquartered in the United States, and U.S. laws govern the information we collect. Do Not Track:
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Data Retention:
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Minors:
The Site is not intended for individuals under the age of 18. If we learn that we have collected personal information of a child without the consent of the child’s parent or guardian, as required by law, we will delete it.

Security:
The security of your personal information is important to us. We employ a number of organizational, technical, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.

Amendments to Privacy Policy:
We reserve the right to modify this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.

California Privacy Rights:
The California Consumer Privacy Act (“CCPA”) applies to consumers residing in California.

Definitions:
Consumer: natural persons who reside in California, including (1) individuals who are in California for other than a temporary and transitory purpose; and (2) individuals who are domiciled in California but are outside the state for a temporary or transitory purpose.

CCPA: the California Consumer Privacy Act of 2018, effective as of January 1, 2020

Personal information: as defined in the CCPA, and includes information that can be used to identify you, either alone or in combination with other information, and any other information that could reasonably be linked with a particular consumer or device.

Consumer Rights:

Right to Access: as a consumer, you have the right to know the following:

  • Categories of personal information we collect about you.
  • Categories of sources from which personal information is collected.
  • Business or commercial purpose for collecting personal information
  • The categories of third parties with whom the business shares personal information.
  • Request the specific personal information the business collected about you in a readily usable format.
  • If a business sells personal information or discloses it for business purposes.
  • Your access rights under the CCPA are not absolute. Specifically, the CCPA limits the information you can request to personal information collected in the 12 months preceding our receipt of the request. Additionally, under the CCPA, Outdoorplay is not obligated to respond to requests for access to personal information more than twice in twelve months. Outdoorplay may, in its sole discretion, choose to provide personal information in response to a consumer’s access request that relates to a time period greater than the preceding 12 months or respond to a consumer request more frequently than required by law; choosing to do so, however, does not constitute an obligation to do so.


Right to Request Deletion:
Consumers also have the right to request the deletion of personal information, but only where that information was collected from the consumer. Your personal information may not be deleted if the information is necessary to:

  • Complete the transaction for which the personal information was collected, provide a good or service requested by the consumer, reasonably anticipated within the context of a business’s ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity.
  • Comply with a legal obligation.


Only you or someone legally authorized to act on your behalf may make a verifiable consumer request related to your personal information. Therefore, your request must provide sufficient information that allows us to verify you are the person about whom we collected personal information or an authorized representative. In addition, your request must describe in sufficient detail, allowing us to understand, evaluate, and respond to it appropriately.

Outdoorplay will deliver the required data to the consumer in an electronically readable format within 45 days of receipt of the verifiable consumer request. This information will be provided free of charge to the consumer.

Right to Opt-Out:
As a consumer, you can opt out of having your personal information sold. Outdoorplay does not sell or rent personal information to anyone.

Right to Equal Services and Non-Discrimination:
The CCPA prohibits businesses from discriminating against consumers by denying goods or services, charging a different price or rate for goods or services, providing a different level or quality of goods or services, or suggesting that they will do any of these things based upon a consumer’s exercise of any CCPA rights.

The right to equal services and prices does not place any restrictions on a business’s ability to collect information or deny service if a consumer does not want to participate in collection; it only applies where the consumer exercises specific CCPA rights, such as opting out of downstream sale of the data.

Nevada Privacy Rights:

  • For Nevada residents, please note that Outdoorplay does not sell personal information as defined by Nevada law (Nevada Revised Statutes, Chapter 603A, Section 1.6). You can submit a request to us at customerservice@outdoorplay.com regarding the sale of such information and provide the following information: First and Last Name, email address, and mailing address.


European User Rights:

  • If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you want to exercise this right, please contact us at customerservice@outdoorplay.com.
  • If you are a European resident, we note that we are processing your information to fulfill contracts we might have with you (for example, if you make an order through the Site) or otherwise to pursue our legitimate business interests listed above.
  • Please note that your information will be transferred outside Europe, Canada, and the United States.
